NightNodes provides the following digital infrastructure services:

• Residential Proxies – IP addresses sourced from real residential devices via consenting partners.
• Static Residential Proxies – Static IPs registered under residential ISPs, hosted on datacenter infrastructure.
• Datacenter Proxies – High-speed server-based IP addresses.
• Mobile Proxies – Carrier-grade 4G/5G IP addresses from mobile networks.
• VPS Hosting – Virtual Private Server instances with root access.
• Custom Infrastructure Plans – Bespoke solutions for enterprise clients.

All services are delivered digitally and are subject to availability. We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

03 Eligibility

To use our Services, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction.
• Have the legal capacity to enter into a binding contract.
• Not be located in a jurisdiction where the use of proxy services is prohibited by law.
• Not be on any government sanctions list or otherwise prohibited from receiving services under applicable law.

By using NightNodes, you represent and warrant that you meet all eligibility requirements.

04 Accounts & Registration

You may be required to create an account to access certain features. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept all risks of unauthorized access.
• Notify us immediately at strawhatproxies@gmail.com if you suspect unauthorized use of your account.
• Be solely responsible for all activity that occurs under your account.

We reserve the right to terminate accounts that violate these Terms or that have been inactive for an extended period.

05 Acceptable Use Policy

Our Services are provided for lawful purposes only. You agree to use NightNodes Services exclusively for:

• Web scraping of publicly accessible data in compliance with the target website's terms of service.

07 Payment & Billing

All prices are displayed in US Dollars (USD) unless otherwise stated. By providing payment information, you authorize us to charge the applicable fees.

• Subscription Plans: Billed on a recurring monthly or annual basis. Subscriptions auto-renew unless cancelled before the renewal date.
• Pay-As-You-Go: Charged based on actual usage as described in the applicable product page.
• Taxes: You are responsible for all applicable taxes in your jurisdiction.
• Failed Payments: If a payment fails, we may suspend your account until payment is resolved.

08 Intellectual Property

All content on the NightNodes platform — including but not limited to logos, text, graphics, software, and dashboard interfaces — is the exclusive property of NightNodes and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works without our express written permission.

09 Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:

• Implied warranties of merchantability or fitness for a particular purpose.
• Guarantees of uninterrupted, error-free, or secure service.
• Accuracy or reliability of any content obtained through the Services.

We do not warrant that our Services will meet your specific requirements or that any defects will be corrected.

10 Limitation of Liability

To the maximum extent permitted by applicable law, NightNodes and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

• Loss of profits, data, goodwill, or business opportunities.
• Damages resulting from unauthorized access to or alteration of your data.
• Damages resulting from third-party conduct or content accessed through our Services.

In no event shall our total liability to you exceed the amount paid by you to NightNodes in the six (6) months preceding the claim.

11 Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for:

• Violation of these Terms or our Acceptable Use Policy.
• Fraudulent, abusive, or illegal activity.
• Non-payment of fees.
• Any other reason at our sole discretion.
